I knew some Marine officers who were permitted to live only because some hardened Marines didn't think it a good deal to kill a fellow countryman. Tossup when the jerkoff was getting people killed and wounded by being incompetent. Close, though, very close.

Uncle Pat was NYPD in the one/seven downtown.
On foot patrol he got into two burglars coming out of busted door. He shot one of them and got the other one down at pistol point. One bum was white, the other black. Pat screwed up by shooting the black guy. And that was in 1958.
Pat got let off after hearings and investigations and ball breakings. He gave the finger to NYPD, and went up to Westchester to serve 30 years with the cops up in Yorktown Heights. I don't even know if my Pop's kid brother is still alive (he'd be 80).
Things were different back then but as an officer NYPD (Patrolman) I remember Pat saying, "I shot a scumbag thief, made two great arrests on foot, and became the bad guy in no time."

BTW - The shot bum went to Beekman Downtown Hospital as walking wounded with a .38 round through the back of his left shoulder. He's probably still alive today if he's gotten by 52 years of being a criminal.
